IMPORTANT MEMBER POLICIES

By booking or using Birdies Golf Lounge (“Birdies”), all members and guests agree to the following:

• Members are responsible for all guests they bring into the facility. Guests below 18 years of age must be accompanied by an adult at all times. 

• Reservations must begin and end within the scheduled booking time.

• Please leave the lounge clean and organized at the end of your session.

• All simulator equipment, screens, launch monitors, furniture, and facility property must be treated with care at all times.

• Members may be held financially responsible for intentional damage, negligence, reckless behavior, or misuse of equipment.

• No unsafe swinging, horseplay, or disruptive behavior is permitted

• BYOB is permitted; however, intoxicated, aggressive, or unsafe behavior will not be tolerated. Underage drinking is strictly prohibited. 

• No smoking or vaping is allowed inside the facility

• Access credentials, door codes, memberships, and booking privileges may not be shared.

• Security cameras are in use throughout the facility for safety and security purposes.

• Birdies Golf Lounge reserves the right to suspend or terminate memberships or bookings for violations of facility policies or inappropriate conduct.

By purchasing, activating, or using a membership with Birdies Golf Lounge (“Birdies”), Member acknowledges that they have read, understood, and agreed to all terms, conditions, policies, and liability waivers contained in this agreement. Use of the facility, booking system, access credentials, simulator equipment, lounge areas, and related amenities constitutes acceptance of these terms and conditions.

1. MEMBERSHIP TERMS

Memberships are personal and non-transferable. Members are responsible for complying with all membership rules, booking policies, and facility guidelines. Access credentials, codes, memberships, and booking privileges may not be shared with non-members or unauthorized individuals. If Birdies determines that a member has shared access, allowed unauthorized use, or permitted non-members to use membership privileges, Birdies reserves the right to immediately suspend or terminate the membership and charge the member up to double the applicable membership fee or booking charges associated with the unauthorized use. Birdies reserves the right to suspend or terminate memberships at any time for unsafe conduct, misuse of equipment, unauthorized access sharing, nonpayment, rule violations, or conduct harmful to the business, its property, members, or guests.

Membership Cancellation Policy:

Members have a 5-day grace period from their billing date to cancel and receive a full refund, provided no membership benefits have been used.

If any membership benefits are used during the 5-day grace period, including tee time bookings, facility access, guest privileges, discounts, or other membership perks, the membership is no longer eligible for a refund and will instead receive 100% Birdies account credit upon cancellation. After the 5-day grace period, all cancellations are eligible for 100% Birdies account credit only. Cancellation will stop future recurring charges.

Member Reservation Courtesy Policy:

We ask that members cancel reservations at least 24 hours in advance whenever possible. Repeated last-minute cancellations or no-shows may result in booking restrictions at Birdies’ discretion to ensure fair access for all members.

2. BOOKING & ACCESS POLICIES

Members agree to follow all booking windows, reservation limitations, session restrictions, guest policies, and membership usage guidelines associated with their selected membership tier.

Reservations may be modified, canceled, or restricted by Birdies when necessary for maintenance, repairs, tournaments, private events, emergencies, operational needs, or scheduling management.

Members are expected to arrive and depart within their scheduled reservation time. Repeated no-shows, excessive cancellations, or abuse of booking privileges may result in membership review, suspension, or termination.

Non-Member Cancellation Policy:

Reservations canceled more than 24 hours before the scheduled start time are eligible for a full refund. Reservations canceled within 24 hours of the scheduled start time will receive 100% Birdies account credit for future use. No-shows are not eligible for refunds or account credits. Booking credits must be used within 6 months of issuance.

3. ASSUMPTION OF RISK

Member understands and acknowledges that participation in golf-related activities, golf simulator use, swinging golf clubs, striking golf balls, alcohol consumption, and use of the facility involve inherent risks, including but not limited to bodily injury, permanent disability, death, slips and falls, flying golf balls, collisions, equipment failure, or actions of other members or guests. Member voluntarily assumes all risks associated with participation in activities at Birdies Golf Lounge.

4. RELEASE OF LIABILITY

To the fullest extent permitted by Texas law, Member releases, waives, and agrees to hold harmless Birdies Golf Lounge, its owners, employees, affiliates, contractors, landlords, and representatives from any claims, liabilities, injuries, damages, losses, costs, or causes of action arising from use of the facility, use of equipment, alcohol consumption, guest conduct, property damage, or participation in activities at Birdies, except in cases of gross negligence or intentional misconduct.

5. GUEST RESPONSIBILITY

Members accept full responsibility for all guests they invite onto the premises, including guest conduct, injuries, damages, misuse of equipment, rule violations, and property damage caused by guests.

Members must ensure all guests follow facility rules and safety guidelines while on the premises.

6. EQUIPMENT & PROPERTY DAMAGE

Members are financially responsible for any damage to Birdies Golf Lounge property caused by themselves, their guests, negligence, misuse, reckless behavior, intentional acts, or failure to follow facility rules and posted instructions. Members authorize Birdies Golf Lounge to charge the payment method on file for the reasonable cost of repair, replacement, cleaning, service calls, lost revenue from downtime, or other expenses resulting from such damage.

This includes, but is not limited to:

• Simulator screens and enclosures

• Launch monitors and tracking equipment

• Projectors, TVs, computers, tablets, and electronics

• Golf clubs, balls, tees, and training aids provided by the facility

• Furniture, fixtures, countertops, and décor

• Walls, flooring, doors, windows, locks, and access systems

• Refrigerators, cabinets, and bar areas

• Restrooms and facility amenities

Facility Cleanliness Fee

Members and guests are expected to leave the facility in the same clean condition in which it was found. Reservations requiring excessive cleanup beyond normal use may be assessed a $50 cleaning fee at Birdies Golf Lounge’s discretion.

7. BYOB & ALCOHOL POLICY

Birdies Golf Lounge permits responsible consumption of alcoholic beverages brought by members and guests who are 21 years of age or older. Underage drinking is strictly prohibited. Members may not provide, share, serve, or allow alcoholic beverages to be consumed by anyone under the age of 21 while on the premises. The member making the reservation is responsible for ensuring all guests comply with applicable alcohol laws and facility policies and assume full responsibility for all alcohol consumption and related behavior while on the premises. Excessive intoxication, disorderly conduct, illegal drug use, smoking, vaping, or any behavior that creates an unsafe environment may result in immediate removal from the facility, suspension or termination of membership, additional fees, and/or notification of law enforcement when appropriate. No illegal substances are permitted. Members agree not to provide alcohol to minors, operate vehicles while impaired, or engage in unsafe conduct while under the influence.

Birdies is not responsible for injuries, accidents, damages, or incidents related to alcohol consumption by members or guests.

8. MINORS

Guests under the age of 18 must be accompanied and supervised by a parent, legal guardian, or responsible adult at all times while on the premises. Members may not leave minors unattended in the facility.

The supervising adult assumes full responsibility for the minor’s conduct, safety, use of equipment, compliance with facility rules, and any damages, injuries, or losses caused by or incurred by the minor.

Birdies Golf Lounge reserves the right to deny access or remove any minor who is not properly supervised.

9. SECURITY & SURVEILLANCE

The premises may be monitored by video surveillance and security systems for safety, operational, and liability purposes. Birdies reserves the right to review surveillance footage when investigating incidents, damages, rule violations, or security concerns.

10. RULES OF CONDUCT

Reckless swinging, fighting, harassment, smoking/vaping indoors, illegal drug use, property damage, unsafe behavior, unauthorized events, or sharing access credentials are prohibited and may result in immediate suspension or termination of membership access. Birdies reserves the right to remove guests or deny access to any individual displaying disruptive, threatening, or unsafe behavior.

11. NO GUARANTEE OF AVAILABILITY

Membership does not guarantee unrestricted reservation availability or unlimited access. Access and booking availability may vary based on demand, scheduling limitations, operational needs, tournaments, maintenance, or private events.

12. IDEMNIFICATION

Member agrees to indemnify and hold harmless Birdies Golf Lounge from claims, damages, liabilities, losses, or legal expenses arising from Member conduct, guest conduct, violations of this agreement, misuse of the facility, or damage caused by Member or guests.

13. SECURITY OF PERSONAL PROPERTY

Birdies Golf Lounge is not responsible for lost, stolen, or unattended personal property brought into the facility, including golf clubs, bags, electronics, wallets, or other belongings.

14. POLICY CHANGES

Birdies Golf Lounge reserves the right to update, modify, or revise these terms, conditions, memberships, pricing, hours, and facility policies at any time without prior notice.

15. ACCEPTANCE OF TERMS

By purchasing, activating, booking, or using a membership with Birdies Golf Lounge, Member acknowledges and agrees that they have read, understood, and accepted all terms, conditions, rules, policies, liability waivers, and responsibilities contained in this agreement.
